An Alabama woman filed a lawsuit yesterday against Apple Inc., claiming that the company’s iPhone 3G drops calls, has trouble connecting to AT&T Inc.’s network and is slower than advertised.
The suit also seeks class-action status, according to papers filed with a federal court.
Dubbing the phone as “Defective iPhone 3G” throughout her lawsuit, Birmingham resident Jessica Smith charged Apple with breach of express and implied warranty, and failing that, unjust enrichment.

The five-page complaint by Romek Figa, who does business in the eastern US state as Abraham & Son, claims that “certain Apple telephones” use technology at the heart of a 1990 patent that describes a system which displays both the phone number of an inbound call. The technique matches up phone numbers with a contact list stored on the phone, allowing the device to associate a name with any incoming calls.

SimulScribe, LLC., a co-defendant with Apple, Inc. in the patent infringement lawsuit recently filed by Klausner Technologies, has settled the litigation and has licensed the Klausner Technologies visual voicemail patents. Other defendants in the case include ATT, Inc., Comcast Corporation and Cablevision Systems Corp.
The license covers SimulScribe’s visual voicemail service, which allows subscribers to selectively retrieve voice messages from a mobile phone or computer display. SimulScribe is the latest defendant, in a series of lawsuits brought by Klausner Technologies over …
